Conditions of Participation in the ELTAKO GmbH Giveaway

These conditions of participation apply to the giveaway organised by Eltako GmbH, located at Hofener Straße 54, 70736 Fellbach (hereinafter referred to as the “Organiser”). Participation in the competition is exclusively governed by these conditions of participation.

1) Duration of the Giveaway

The giveaway will run from January 1, 2024, 00:00, to December 31, 2024, 10:00, and is divided into four quarterly draws. During this period, participants can enter the giveaway online.

2) Eligibility and Exclusion

1. All natural persons who have reached the age of 18 are eligible to participate.
2. Employees of the Organiser and their relatives are excluded from participation.
3. Multiple entries within a given quarterly giveaway period (see Section IV) and participation via (especially automated) giveaway entry services are not allowed.
4. The Organiser reserves the right to exclude participants who provide false and/or incomplete information or violate these terms and conditions, as well as to retroactively revoke or reclaim any prizes.
5. Participation in the giveaways is not tied to the purchase of an Organiser’s product.

3) Start/End of Giveaways

Participants can enter the giveaway during the following time periods:
1st Quarter 2024: January 1, 2024, to March 31, 2024
2nd Quarter 2024: April 1, 2024, to June 30, 2024
3rd Quarter 2024: July 1, 2024, to September 30, 2024
4th Quarter 2024: October 1, 2024, to December 31, 2024 (10:00 AM)

4) Participation

Participants can enter by filling out the form on the 75th anniversary ELTAKO landing page. Each participant can register for the prize draw only once per quarter. Participation in the giveaway is free of charge.

5) Winner Selection

Winners will be randomly selected once per quarter after the participation deadline. The participation deadline is always the last day of the quarter at 11:59 PM. The draw takes place the next day, and winners will be promptly notified via email.

6) Prizes

The giveaway includes the following prizes:
1st Place: iPad 10th Gen, Wibutler Pro 2, Onwall-sz, and other items with a total value of €1854.60.
Places 2-5: Wibutler Pro 2, Onwall-sz, and other items with a total value of €1275.60.
Places 6-10: Various items with a total value of €435.40.
Places 11-75: MFZ12DBT-UC with a value of €101.10.
Prizes will not be paid out in cash, and any prize claim cannot be transferred to others.

7) Notification and Prize Claim

1. Winners will be notified via the email address provided in the contact form and asked to confirm their shipping address for eligible prizes.
2. If a winner does not confirm their shipping address within 14 days of the Organiser’s request, the prize claim expires.
3. The prize claim also expires if the prize cannot be delivered to the specified address.

8) Data Privacy

By participating in the giveaway, we process the data you provide, including salutation, first name, last name, place of residence, and email address. This processing is for the purpose of fulfilling the giveaway contract, especially for determining and notifying the winners. The legal basis for data processing is Art. 6(1)(b) of the GDPR. 9) Miscellaneous

2. legal recourse is excluded.
3. the law of the Federal Republic of Germany shall apply.
4. should individual provisions of these terms and conditions be or become invalid, the validity of the remaining provisions shall remain unaffected.
5. the EU offers a platform for out-of-court online dispute resolution. This can be found at https://ec.europa.eu/consumers/odr/. The organiser is neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board.
